Depending upon how you interact with NOSTALO, we may receive your name and contact details; account or login information; billing and delivery information; order and transaction information; customer-service communications; photographs, captions, text and other content submitted for creating your personalised product; and technical or usage information generated through interaction with our website or services.
We process information for purposes connected with providing and improving our services, creating and fulfilling orders, communicating with customers, providing support, maintaining appropriate records, securing our services, preventing misuse and meeting applicable legal requirements.
Uploaded Photographs & Creative Content
Photographs and creative content submitted by customers are intended primarily for providing the service requested by the customer. NOSTALO does not acquire ownership of your photographs merely because they are uploaded to our platform.
Your content may necessarily be processed, transmitted or stored through systems operated by technology, hosting, cloud-storage, software, production, communication or other service providers used in delivering the NOSTALO service.
We do not sell customer photographs as a commercial product, and we will not ordinarily use private customer photographs for unrelated public advertising or promotional purposes without appropriate permission.
Payment Information
Payments may be handled by independent payment gateways or payment-service providers. Depending upon the payment method used, NOSTALO may not receive or retain complete card, banking or other sensitive payment credentials entered directly into a payment provider's system.
Service Providers & Required Disclosures
We may share or make information accessible to service providers only to the extent reasonably required for functions such as website operation, software services, data storage, payment processing, communications, production, order fulfilment, shipping, security or customer support.
We may also disclose information where reasonably necessary to comply with applicable law, legal process or lawful governmental requirements, or to protect legitimate legal rights and prevent fraud or misuse.
Security of Digital Platforms
We take reasonable care and commercially appropriate measures in handling customer information and uploaded content. However, no website, cloud service, electronic storage method, internet transmission or digital infrastructure can be guaranteed to be completely secure or immune from unauthorised access, cyber-attacks, malware, hacking, technical failure, data corruption or unforeseen vulnerabilities.
Accordingly, to the maximum extent permitted by applicable law, NOSTALO and Promisca Lifecare LLP shall not be responsible for unauthorised access, loss, disclosure, corruption or misuse arising solely from circumstances beyond our reasonable control, including attacks, breaches or failures affecting independent third-party systems. Nothing in this provision limits any responsibility that cannot lawfully be excluded.
Retention of Projects, Images & Information
Under the current NOSTALO service, a photo-book project and its associated uploaded photographs may remain available in the customer's account for up to 365 days from the earlier of the date of purchase or the customer's first login, after which the project and associated uploaded content are intended to be automatically deleted from the active NOSTALO system.
Other personal information, transaction records, support communications or limited technical backups may be retained for longer where reasonably necessary for legitimate operational, accounting, dispute-resolution, security or legal requirements. Backup copies may not disappear instantaneously from all third-party systems when active content is deleted.
Customers should maintain their own originals and backups. NOSTALO should not be regarded as a permanent photograph-storage or archival service.
Your Choices & Requests
Subject to applicable law and technical or record-keeping requirements, you may contact us regarding your personal information, including to seek access, correction or other action available under applicable law. Where processing is based on consent, requests concerning that consent will be handled in accordance with applicable law.
Customer Responsibility
Please do not upload material that you consider exceptionally confidential, highly sensitive, legally restricted or irreplaceable unless you are comfortable with the inherent risks of electronic transmission, processing and storage.
By uploading photographs depicting other individuals, you should ensure that you have any permission or lawful authority reasonably necessary for the intended use.
Children's Content
Our products may naturally include family photographs and photographs of children supplied by parents, guardians or other customers authorised to use them. The NOSTALO purchasing service is not intended to enable children to independently enter into transactions with us; a person placing an order should have the legal capacity and necessary authority to submit the content concerned.
Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our services, technology, business practices or applicable legal requirements. The latest version will be made available on our website.
