Our Products & Services

NOSTALO creates personalised, made-to-order photo products using photographs, text, layouts and other content selected or supplied by customers.

Product formats, specifications, sizes, materials, prices, features and availability may change from time to time. The specifications displayed for a particular product when an order is placed will apply to that order, subject to reasonable manufacturing tolerances and these Terms.

Your Content

You retain ownership of photographs and other original content uploaded or submitted by you.

By submitting content to NOSTALO, you grant us a limited, non-exclusive right to use, reproduce, process, resize, crop, arrange, transmit and otherwise handle that content only to the extent reasonably necessary to provide the requested service, produce and deliver your order, provide customer support, maintain appropriate operational records and meet applicable legal requirements.

NOSTALO does not acquire ownership of your photographs merely because they are uploaded to our platform.

Your Right to Use Uploaded Content

By uploading or submitting photographs, text, artwork or other material, you represent that you own the content or have the permissions or lawful authority necessary to use, reproduce and submit it for the purpose requested.

You are responsible for ensuring that content supplied by you does not unlawfully infringe another person's copyright, privacy, publicity, intellectual-property or other rights.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Promisca Lifecare LLP, NOSTALO and their partners, employees and representatives against third-party claims, liabilities, losses and reasonable costs arising directly from your unlawful submission or use of content, or your material breach of these representations.

Content We May Decline

NOSTALO reserves the right, acting reasonably, to decline, suspend or cancel production of material that appears unlawful, infringing, threatening, hateful, grossly offensive, exploitative or otherwise inappropriate for us to reproduce, or which we reasonably believe could expose NOSTALO or another person to legal liability.

Creating & Approving Your Book

NOSTALO provides tools, templates and layouts to help customers create personalised products. Certain functions may use automated or software-assisted placement, cropping, sizing or arrangement.

Customers should carefully review the final project or preview before submitting it for production, including photographs, image quality, cropping, positioning, page sequence, captions, names, dates, spellings and all other personalised content.

Once a customer-approved project enters production, errors or choices contained in the submitted design ordinarily cannot be corrected and will not constitute a manufacturing defect attributable to NOSTALO.

Orders & Acceptance

An order is treated as confirmed after successful payment and acceptance into our order system. NOSTALO may nevertheless decline or cancel an order before production where it cannot reasonably be fulfilled, including because of an evident pricing or technical error, payment failure, suspected fraud or misuse, unavailable materials, unlawful content or another genuine impediment to fulfilment.

If NOSTALO cancels an order for reasons attributable to us before fulfilment, amounts paid for the unfulfilled order will be refunded as appropriate.

Prices & Payments

Prices displayed on the website are in Indian Rupees (₹) unless expressly stated otherwise. Applicable taxes, delivery charges and other compulsory charges, if any, will be presented in connection with the order before payment.

Prices and promotional offers may change from time to time. Obvious typographical, technical or system-generated pricing errors do not oblige NOSTALO to supply a product at an unintended price; where such an error affects an order, we may offer the customer the choice to proceed at the correct price or cancel the affected order.

Payments may be processed through independent payment-service providers and may additionally be subject to their terms and security procedures.

Product Representation

We endeavour to represent our products accurately. However, photographs and visual representations on our website are illustrative, and physical materials and printed images can differ from their appearance on a digital screen.

Reasonable variations in colour, tone, brightness, cropping, positioning, texture, dimensions, binding and finish may arise from screen characteristics, source-image quality, printing and manufacturing processes and normal production tolerances. Minor variations that do not materially impair the intended use or overall quality of the product are not ordinarily considered defects.

Production, Delivery, Cancellations & Remedies

All NOSTALO products are personalised and made to order. Production, shipping, delivery, cancellation, return, replacement and refund arrangements are governed by our Shipping & Delivery Policy and Cancellation, Returns & Refund Policy, which form part of these Terms.

Nothing in these Terms or our policies is intended to exclude any consumer right or remedy that cannot lawfully be excluded.

Intellectual Property

The NOSTALO™ name, logo, visual identity, website design, original graphics, templates, layouts, text, software elements and other proprietary material made available by us are owned by or licensed to Promisca Lifecare LLP, as applicable, and are protected by applicable intellectual-property laws.

They may not be copied, reproduced, commercially exploited, republished, distributed or used to create competing products or services without prior written permission, except to the extent expressly permitted by law. This does not give NOSTALO ownership of customer photographs or other original customer content.

Third-Party Services & Website Availability

Certain aspects of our services depend upon third-party providers, including hosting, cloud storage, design technology, payment processing, communications and logistics. Although we endeavour to work with appropriate service providers, NOSTALO does not control every aspect of their infrastructure or operation and cannot guarantee uninterrupted availability of third-party systems.

We may temporarily restrict or suspend access where reasonably necessary for maintenance, upgrades, security, technical issues or circumstances outside our reasonable control.

Events Beyond Our Reasonable Control

NOSTALO will not be responsible for delay or failure caused by circumstances reasonably beyond our control, including natural events, fire, flood, governmental restrictions, transport or courier disruption, strikes, power or telecommunications failures, cyber incidents, equipment breakdown, material shortages or failure of third-party infrastructure or services.

Where such circumstances affect an order, we will endeavour to resume or complete performance within a reasonable period and deal with the affected order in accordance with applicable law.

Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Subject to that qualification, and to the maximum extent permitted by applicable law, NOSTALO and Promisca Lifecare LLP will not be liable for indirect, incidental, special or consequential losses arising from use of the website, customer-supplied content, delays beyond our reasonable control or use of our products or services.

NOSTALO is not an archival or permanent-storage service, and customers remain responsible for retaining original and backup copies of photographs and other important content.

Privacy

Our handling of personal information and uploaded content is governed by our Privacy Policy, which forms part of these Terms.

Changes to These Terms

We may revise these Terms from time to time to reflect changes in our products, services, technology, business practices or applicable requirements. The version published on our website when an order is placed will ordinarily apply to that transaction.

Governing Law

These Terms and transactions with NOSTALO are governed by the laws of India. Subject to any rights or forums available to consumers under applicable law, disputes relating to these Terms or our services shall be subject to the jurisdiction of the competent courts at Gurugram, Haryana.
